Police planted over Ksh5.5M on w***n to fix Justice Chitembwe – court told

High Court Judge Justice Said Juma Chitembwe says over Ksh5.5 million that was recovered from Justice Aggrey Muchelule's chamber belonged to an unidentified lady who was brought into the chamber by police officers.

"The said officers also brought into chambers of the 1st interested party an unidentified lady seemingly under arrest and without introduction to us, proceeded to the toilet where she was searched and $50,000 ( over Ksh5.5 million) allegedly recovered from her," the judge's affidavit read in part.

The judge has also narrated how he was arrested by the DCI officers while leaving Justice Muchelule's chambers where he was asking him to accompany him for tea on the fourth floor of Milimani Law Courts. 

The judge had allegedly informed his colleague that he had already taken his tea so he decided to proceed alone.

"Outside the door of the 1st interested party's office, I met three persons who introduced themselves as police officers and ordered me back into the chamber of the 1st interested party for an operation as they called it, "read the affidavit in part.

Chitembwe claims nothing was recovered and that the officers issued a search certificate that was executed to confirm the same.

He however agrees that another USD7,000 was recovered from his pockets but claims the money was for purposes of paying his son's school fees in Australia.

He says his family has kept a dollar account under his wife's name for over three years and as such it is not usual or suspect for him to have US dollars in his possession as it was claimed by the police.

The judge says he was neither informed of the nature of the crime that was being investigated against him nor the accuser.
