The Director of Public Prosecutions Noordin Haji says he will appeal the freeing of businessman Humphrey Kariuki.

Kariuki was on Tuesday, December 8 acquitted of Ksh7.4 million tax evasion charges after the prosecution failed to present witnesses against the liquor magnate.

The DPP says Kariuki’s acquittal has attracted public uproar, vowing to return to the courts to seek the businessman’s pinning.

The DPP wants certified handwritten notes of the proceedings that led to the unconditional release of Kariuki.

"In the interest of justice, and given the public interest concerning the matter, we would be grateful if we get the handwritten proceedings immediately in order to enable us lodge an appeal,” reads Haji’s letter to the Milimani Law Courts.

Following his acquittal Tuesday, the businessman is left with two more tax evasion charges to fight. Kariuki is accused of evading taxes amounting to Ksh41 billion.

The cases are before magistrates Martha Mutuku and Francis Andayi.
