Matiang’i off the hook as DPP fails to institute charges against him

Director of Public Prosecutions (DPP) Noordin Haji now says there is no sufficient evidence provided to charge former Interior Cabinet Secretary Fred Matiang'i over a raid in his Karen home last month.

Haji in a statement on Monday, March 13, said the Directorate of Criminal Investigations (DCI) failed to provide evidence to sustain two charges leveled against the former CS.

"The recommendation by the investigating officer was that Dr. Fred Okeng'o Matiang'i and his advocate Mr. Danstan Omani be charged for the following offences: (a) Conspiracy to commit a felony contrary to section 393 of the Penal Code. (b) Publication of false information contrary to section 23 of the Computer and Misuse and Cybercrime Act No. 5 of 2018 Upon independent and thorough analysis of the evidence availed and a review of the statements of the witnesses, the Director of Public Prosecutions found that the evidence provided was not sufficient to sustain the above charges against Dr. Fred Okeng'o Matiang'i and his advocate Mr. Danstan Omani.

"The evidence provided did not meet the ingredients needed to prove each of the afore-mentioned offences as required by law," Noordin stated.

He further asked the DCI to drop the charges with immediate effect.

"The Director of Public Prosecutions has therefore directed the Directorate of Criminal Investigations to close the inquiry file with no further police action," he added.
