Waititu’s Ksh588M corruption case adjourned

The Milimani Law Courts has adjourned a corruption case where former Kiambu Governor Ferdinand Waititu and 12 others were charged with an irregular award of a Ksh588M road tender.

The impeached governor's defence team had filed an adjournment request, which was granted by the Milimani Law Courts Chief Magistrate.

Disgruntled by the decision, the Office of the Directorate of Public Prosecution stated that they were prepared to produce more witnesses before the court.

The hearing of the case has now been set for October 14.

“The prosecution led by Faith Mwila and Linda Mwamburi was ready with two witnesses. The prosecution has produced 27 witnesses in the case,” the prosecution agency said.

Waititu's Ksh1.9B wealth frozen

In June 2022, the High Court froze Waititu's wealth worth at least Ksh1.9 billion. The court stated that the wealth was feared to have been obtained through corruption while he served as an MP and a governor.

Among the properties that were frozen included; seven motor vehicles and 18 properties in Waititu's name, his companies, relatives, or cronies.

"An order of injunction be and is hereby issued restraining the defendants and interested parties, their agents, servants, and/or any other person from selling, transferring, charging, disposing of, wasting, or in any other way alienating the following properties pending the hearing and determination of this application," the court ruled.

Waititu's wealth

The wealth is owned in the name of his close family members and his companies including his wife Susan Wangari (928.9 million), Saika Two Estate Developers Limited (Ksh906.3 million), Bienvenue Delta Hotel (Ksh56.9 million), and Bins Management Services Limited (Ksh62.7 million).

The wealth, according to the Ethics and Anti-Corruption Commission (EACC), was acquired during Waititu's tenure as MP for Kabete Constituency between 2015 and 2017 and as Governor for the County Government of Kiambu between 2017 and 2020.

"The Governor engaged in schemes to embezzle public funds through fictitious and/or fraudulent procurement contracts. He concealed or otherwise disguised his private interest in tenders awarded to companies contracted to offer services to the County Government of Kiambu.

The contractors, upon payment transferred proceeds of the fictitious/fraudulent procurement contracts to Mr. Waititu, his wife (Susan Wangari), and their companies - Saika Two Estates Developers Limited, Bienvenue Delta Hotel, and Bins Management Services Limited as kick-backs.

The Governor further directly traded with the County through companies registered in the names of his wife, and their daughter - Suwanga Limited, Connex Logistics Africa Limited, and Modiba Management Services Limited," EACC said in a statement.
