Politician in Ksh24M con case charged in another Ksh8M fraud case

A Turkana-based politician has been charged with obtaining money by false pretences, weeks after he was charged in a fraud case involving over Ksh24 million.

In the new fraud case, Simon Ekai Ewoi was charged with obtaining Ksh8,049,000 from Lydiah Mary Munyoki by false pretences.

According to the Office of the Directorate of Public Prosecutions (ODPP), Ekai was recently charged with obtaining Ksh24,263,780 through fraud.

"The Turkana county politician who was recently charged with obtaining Ksh 24,263,780 by false pretences in a Mombasa court has been slapped with a fresh similar charge," ODPP stated.

Ekai was charged before Mombasa Senior Resident Magistrate David Odhiambo. ODPP says he was charged with the fifth count of obtaining Ksh8,049,000 by fraud from Lydiah Mary Munyoki.

The court was informed that Ewoi solicited the money by falsely claiming that the Central Bank of Kenya had frozen his assets and that he required help to unfreeze them.

"He allegedly told the complaint that in exchange, he would buy her a parcel of land, a fact he knew to be false," ODPP added.

He is reported to have committed the offence on diverse dates between January 11, 2022, and July 18, 2022, in Mombasa County.

He denied the charge and was released on a Ksh4 million surety bond.

The court directed that the matter be mentioned on April 24, 2024.

Ksh24M fraud

In March, Ekai was charged before the same court with obtaining Ksh24,263,780 by false pretences connected to the gold and mercury trade.

Ekai was arraigned before Senior Resident Magistrate David Odhiambo to face four counts of obtaining money by false pretences, contrary to Section 313 of the penal code.

The court heard that the accused and his accomplices obtained a total sum of Ksh24,263,780 from four complaints by falsely pretending that he was in a position to partner with them in the gold and mercury trade.

He pleaded not guilty to all counts, with the prosecution opposing his immediate release on bail since he was under further police investigations.

In his ruling, the trial magistrate ordered Ewoi to be detained for fourteen days at the Central Police Station to allow detectives to complete their investigation.

The court directed that he be produced in court on 8th April 2024, where he would be released on a Ksh7 million bond with a surety of a similar amount and two guarantors with clear details of their residences.

The case is ongoing.
