Man in court to stop former Kangema MP Ngahu’s burial

Uncertainty surrounds the burial of the former Kangema MP Tiras Ngahu after one of the Kangema residents moved to court seeking orders to bar the family from burying the former MP at his home in Tuthu, Kangema.

Gabriel Macharia Njoroge filed the application at Kangema Law Courts under a certificate of urgency seeking orders to stop the burial which was slated for Wednesday next week until the case is heard and determined.

The late former lawmaker's wife Lydia Njoki Maguta has been enlisted as the defendant in the case.

Macharia claims that he holds the original title deed of land parcel Loc/9/Kiruri/459 which is the mother title to land parcel Loc/9/1262 where the late MP has built his home.

Macharia claims that the piece of land was fraudulently subdivided thus Ngahu did not acquire it legally.

In a case filed at the Environmental Lands Court in 2017, Macharia claims that the former MP registered himself as the owner of the parcel of land without the estate being succeeded.

The court, however, established that the land was subdivided in 1992 before Ngahu acquired the land from a third party hence exonerating him from the alleged fraud.

In her ruling on February 27, 2020, Justice Gladys Kimei dismissed the case noting that Macharia was unable to prove his claims. Justice Kimei, therefore, certified Ngahu as the legitimate owner of the land.

The inter-party hearing for the case has been slated for March 9.

Efforts to reach Ngahu's family for comments over the matter were not fruitful.
