EACC in tussle with former MP over land hosting Kadhi’s Court

The Ethics and Anti-corruption Commission (EACC) has taken to court former Makueni MP and Agriculture Assistant Minister Peter Maundu and former Commissioner of Lands Wilson Gachanja over a parcel of land hosting the Kadhi's Court in Nairobi.

According to the anti-graft agency, the land had been fraudulently allocated to the MP by the commissioner.

"EACC has moved to court to recover the property currently hosting the Nairobi's Kadhi's Court in Upper Hill from grabbers. The property was fraudulently allocated to former Makueni MP and Agriculture Assistant Minister Peter Maundu by former Commissioner of Lands Wilson Gachanja," EACC stated.

In the recovery suit filed on May 11, 2023, Wilson Gachanja has been sued in his personal capacity on account of fraud, illegality, and/or acting ultra vires his powers and functions.

EACC prayers

The anti-graft agency wants him ordered to pay general damages for fraud and breach of fiduciary duty.

In court filings, the commission says the land is currently owned by a private company associated with the former legislator.

"Although the Judiciary is in actual possession and in use of the Kadhi’s Court, the property is illegally owned by a private company that acquired it from the former Makueni MP. EACC wants the illegal ownership nullified and the property reverted back to the Judiciary," the commission stated.
