Daniel Kemboi was set to be arraigned at the Kabarnet Law Courts on Monday, November 2, 2020.

A Standard Seven pupil from JK Moi (Kaburwo) Primary School in Baringo County, who is alleged to have killed a fellow classmate, has been charged with murder.

The pupil, whose name was withheld because is a minor, was charged with murder on Wednesday, January, 27 at the Kabarnet High Court.

According to the charge sheet, the minor allegedly hit his classmate, Tony Lobenyo, in the head with a wooden plank. The victim, the prosecution contends, fell down unconscious and was taken to Mercy Mission Hospital in Eldama Ravine Sub-County where he died.

The incident occurred on January 8, 2021, at about 3:45 pm at the school within Koibatek Sub-County.

While appearing before Justice Justus Bwonoga, the accused pleaded not guilty to the offense.

“I did not intend to kill him, it was accidental. We just had a heated altercation and I just discovered that I had hit him on the head,” submitted the suspect.

The state prosecutor, George Mong’are while presenting his submissions, said that the murder suspect had been found fit to stand trial.

Mong’are tabled before the court copies of the evidence, which includes photographs of the scene, victim, and postmortem report from Moi Teaching and Referral Hospital, Eldoret.

Justice Bwonoga ordered that the murder suspect be remanded in the juvenile wing of Nakuru Prison.

The case will be mentioned on February 11, 2021, with the pretrial on February 25.
