Voter files 1st pet*tion against Ruto’s election at Supreme Court

The first presidential petition against the election of Deputy President William Ruto has been filed at the Supreme Court by a voter, John Njoroge Kamau.

The petition has been received by Kasavuli Bernard, Deputy Registrar of the Supreme Court who is currently processing the same.

The petitioner has listed IEBC chairman Wafula Chebukati, Ruto, his running mate Rigath Gachagua and IEBC as respondents, respectively. Raila Odinga, Martha Karua and IEBC Commissioners Juliana Cherera, Irene Masit, Justus Nyang'aya, Francis Wanderi, Professor Abdi Guliye and Boya Molu are listed as interested parties.

In the petition, he wants nine declarations among them that the constitutional mandate for tallying and verifying election results as received from the polling stations by the National Tallying Centre has to be undertaken by all the IEBC commissioners and not the Chairman unilaterally.

His second prayer is for a declaration that the presidential election held on August 9, 2022, was not conducted in accordance with the constitution and the applicable law, rendering the declared results invalid, null and void.

Kamau further wants the court to find that IEBC and its Chairman Wafula Chebukati do not have the power to postpone the date of the general elections.

His fourth prayer is a declaration that Ruto and his deputy were not validly declared as the president-elect and the deputy elect respectively.

He is also seeking an order to quash the gazettement of Ruto and Gachagua as president-elect and deputy-elect.

The petitioner is also seeking an order directing the IEBC to organize and conduct a fresh presidential election in strict conformity with the Constitution and the Elections Act.

"A declaration that Chebukati has violated Article 10 and 73 of the constitution and that IEBC chair committed election irregularities and illegalities and should therefore be investigated for possible criminal culpability," Kamau says in his petition.

Further, Kamau wants an order prohibiting Chebukati from acting as returning officer of any subsequent presidential election and be barred from holding any public office.
