Kibera court sentences man to 60 years in prison for defiling 2-year-old baby

A man has been slapped with a 60-year jail term for defiling a two-year-old child by Kibera Law Courts.

The man, identified as Rodgers Alianda Atseka, faced two charges of defilement under Section 8(1) and committing an indecent act with a child under Section 11(1) of the Sexual Offences Act No.3 of 2006.

"The accused person, Rodgers Alianda Atseka was charged with two counts: Defilement Contrary to Section 8(1) as read with Section 8(2) of the Sexual Offences Act No. 3 of 2006 and Committing an Indecent Act with a Child, contrary to Section 11(1) of the Sexual Offences Act No. 3 of 2006," ODPP stated

In a statement shared by the Office of The Director Of Public Prosecutions (ODPP), the accused was accused of luring the toddler away from her playmates on July 25, 2022, under the pretence of buying candy.

According to the DPP, the prosecution, represented by Miss Jane Gitahi, presented a compelling case, calling upon seven witnesses to testify.

"The accused person is said to have lured the minor from where she was playing with her friends in the pretext of going to buy candy for her. The prosecution through Miss Jane Gitahi called seven (7) witnesses, and when the accused was placed on his defence, he was unable to dislodge the prosecution case," the statement read.

ODPP said the accused, in his defence, failed to undermine the prosecution's case, leading to the severe sentencing.

In a separate case, a 47-year-old Tana River County primary school head teacher, Athman Mohammed Jillo, has been sentenced to 15 years in prison for defiling a 16-year-old pupil.

Jillo allegedly coerced the minor into engaging in sexual activities with the promise of securing a favourable grade in the Kenya Certificate of Primary Education (KCPE).

According to ODPP, Hola Resident Magistrate Benson Kabanga handed down the sentence after determining that the prosecution, led by Prosecution Counsel Michuki Alfred, had convincingly proven the case.

"The prosecution, led by Prosecution Counsel Michuki Alfred, called eight (8) witnesses who testified and established a case against the accused person. In his sentence, Hon. Kabanga stated that Jillo abdicated his responsibility to protect his student from any form of harm or abuse," ODPP stated.
