Kakamega Senator Boni Khalwale has given businessman Cleophas Shimanyula Toto a 48 hour-ultimatum to pay him Ksh200 million lest he sues him for Ksh500,000.

Khalwale accuses the businessman of defamation for linking him to the death of his late worker Kizito Amukune Moi who was killed by his fighter bull.

The firebrand politician lamented that Shimanyula Toto made false statements on social media, casting doubt on the police investigation into the death of the bull caretaker.

In a demand letter, Khalwale requested that Shimanyulu retract the said defamatory statements in writing within the next 48 hours.

The Kakamega senator reiterated his demand to Shimanyula Toto in a statement on social media.

Khalwale insisted that the businessman should apologize and pay him Ksh200 million failure to which he will sue him for Ksh500 million.

"Today at the High Court of Kenya, we have given Cleophas Shimanyula Toto 48 hours, within which he should tender an apology for defamatory allegations against me & pay a compensation of Ksh 200 million. Failing which he will face a suit of Ksh. 500 million in the High Court," Khalwale wrote on his X account.

No foul play

Chief government pathologist Johansen Oduor strongly refuted rumours alleging that Boni Khalwale was behind the death of his farmhand.

Addressing the press on Saturday, February 3, 2024, Oduor revealed the autopsy results saying Kizito Moi Amukune was indeed gored to death by the senator's famous fighting bull 'Inasio'.

Announcing the results, the pathologist stated that the deceased suffered injuries on his forehead, neck and thighs and that the injuries looked as if they were caused by something resembling a horn.

Oduor further reiterated that, unlike the earlier rumours that the senator had a hand in his farmhand's demise, the deceased succumbed to his injuries from the bull.

"The autopsy was performed by local pathologist Dr Mchana, however, there were some complaints which led to us being called here to do a repeat. From my findings, the late Kizito had injuries, one injury was of the forehead on the right side, and the ulterior neck on the inner thigh of the left leg, looking at these injuries, they were penetrating and had features which included bruising around them and to look at them closely, they look like injuries which were caused by something penetrative but not very sharp, something a bit blunt, which is in-keeping with a horned animal," he stated.
