IEBC picks ex-AG Githu Muigai to lead its legal team in Raila’s presidential petition

The Independent Electoral and Boundaries Commission has picked former Attorney General Githu Muigai to lead its legal team in the presidential petition.

The electoral body contracted the accomplished lawyer to lead its team of advocates following a confirmation by the Azimio la Umoja One Kenya Alliance presidential candidate Raila Odinga that he will contest the results of the presidential elections at the Supreme Court.

Muigai will be making a consecutive appearance in a presidential elections petition, having been enjoined as a friend of the court in Raila's 2017 petition.

As a friend of the court, known as Amicus Curiae, the then Attorney General was an independent respondent and only offered his legal opinion to the bench.

Judiciary issues timelines for presidential petition

Last week, the Judiciary announced the timelines and guidelines for challenging the newly released presidential results.

In a notice dated Monday, August 15, 2022, the Judiciary told all advocates, litigants and members of the public who may wish to file a petition to do so 14 hours before the deadline, Tuesday, August 23.

"Take further notice that, under Rule 7(3) of the Supreme Court (Presidential Election Petition)Rules, 2017, where the petition is filed on the last available day of filing, it shall be filed before 1400hrs of that day," the notice read in part.

The notice further stated that all who wish to petition should do so at the Supreme Court sub-registry located at Forodha House adjacent to Milimani Law Courts along Upper Hill Close Road.
