DPP recommends inquest into Jeff Mwathi's death - DJ Fatxo's lawyer

A lawyer representing Lawrence Njuguna alias DJ Fatxo now says the Director of Public Prosecutions Noordin Haji has recommended an inquest to establish the cause of Jeff Mwathi’s death.

Lawyer Duncan Okatch in a media briefing on Wednesday, May 17, 2023, stated that DPP agreed with the findings of the Directorate of Criminal Investigations (DCI ) that there was no evidence to suggest criminal culpability on DJ Fatxo's part.

“Our client is happy that the truthful position he has always espoused and maintained with regard to his innocence has come out at last,” Okatch said.

He said the DJ is thankful to the DCI and the DPP for exhibiting great standards of professionalism, independence and focus despite what he termed as clearly orchestrated public and social media machinations aimed at obfuscating the truth and injuring his reputation.

"It is clear that there is no single shred or iota of evidence to suggest any remote criminal culpability by our client or suspicion thereof. In fact, it is very clear that our client was not even at his house at the time that his friend, Jeff Mwathi met his death,” the lawyer added.

According to the lawyer, DJ Fatxo will not be seeking legal redress against all those who propagated "lies" that he was culpable of the death.

“Our client being a practising Christian has consciously decided to forgive all those who propagated such narratives and he only hopes that through his tribulations, those who had been led into believing such or in one way or another became part of the social mob justice, cyberbullying and Kenyans in General, have learnt a thing or two,” the lawyer said.

The lawyer noted that it has not been easy for DJ Fatxo and if it were not for his special relationship with God, support from his parents, friends and many fans who still called, messaged or in one way or another showed solidarity with him, he might not even have been in a state to even witness and comprehend the moment of vindication.

“DJ Fatxo will now resume his normal life and do what he does best which is ensuring people shake their legs and he hopes that this challenge that has been surmounted will impact positively on any person who may find himself already judged even before his side of the story is heard,” he added.

The singer has been on the spot after the 22-year-old interior designer died inside his apartment.

Jeff Mwathi's family insists that the deceased was thrown out of the 10th-floor window of the DJ's house at Redwood Apartments in Kasarani on February 22, 2023. The DJ, however, insists that Mwathi took his own life.

The investigation into Mwathi's death was concluded on April 19 with detectives from DCI saying they have since forwarded the file on the probe to the DPP for "perusal and advice".

“The Directorate of Criminal Investigations has this afternoon completed investigations into the death of Jeff Mwathi, 23, who died on February 22, 2023, in unclear circumstances.

“This is after the Homicide department, that has been investigating the incident received an autopsy report from the government Pathologist and the government Chemist, following a fresh probe into the death as ordered by the DCI Director, Mr Mohamed Amin," read the statement.
