‘I did not see Babu Owino with gun,’ DJ Evolve testifies

Felix Orinda alias DJ Evolve has told a Milimani court that Embakasi East MP Babu Owino did not shoot him.

Testifying from his bed virtually DJ Evolve informed Senior Principal Magistrate Bernard Ochoi that on the morning of January 17, 2020, he did not see the MP shoot him.

"Did you see Babu Owino with a gun?” asked defence lawyer Duncan Okatch.

“No, we were just having conversations with Owino and the next thing l was in an ambulance going to the hospital," DJ Evolve told the court.

Led in his evidence by defence lawyer Duncan Okatch, the DJ states that Owino was his personal friend since 2017.

Asked by the lawyer whether he knew what happened, he said he doesn't know.

The DJ further informed the court that after the incident Owino has been the only one who has been assisting him to cater for his upkeep including hospital bills and other personal utilities.

The entertainer went ahead to say that prior to the shooting there was no commotion and the lighting at the B Club had been toned down

The DJ further disclosed that he never saw Owino with a firearm inside the club

He told the court that he was not coerced to testify in defence of Owino.

The DJ's testimony was corroborated by Owino's bodyguard Edwin Gedi Otieno who said that the B- Club Owino deposited his gun and nine rounds of ammunition at the club's armoury.

The firearm was kept by one Charles Ochieng the custodian of the armoury.

Gerdi told the magistrate that Owino's gun could not fire as it had jammed on January 15, 2020, at the Ngong Shoot range.

Earlier ballistic expert who examined the firearm told the court it could not fire.

The armoury custodian told the court that he retained Owino's firearm until 7 am on January 17, 2020, when he handed over the gun to the MP

Otieno told the court that he had to follow the MP to the van that was taking the injured DJ to the hospital.
