CS Jumwa writes to DPP seeking withdrawal of her murder case

Gender and Public Service Cabinet Secretary (CS) Aisha Jumwa has written to the Director of Public Prosecutions (DPP) seeking to withdraw the murder case against her pending at the Mombasa court.

The CS, through his lawyer Danstan Omari, claims she has approached the DPP through several letters with a view to having her case reviewed with the intention to drop it.

Speaking to journalists at Milimani law courts on Wednesday, November 11, Omari said the defence team re-evaluated the evidence availed to them by the prosecution in the matter and is of the view it cannot sustain the charge against Jumwa.

Omari said that they had also supplied the office of the DPP with sufficient evidence that Juma did not own a gun and did not shoot anyone as alleged.

“It is in the line of duty of the DPP to apply for the withdrawal of a matter before the court. The ODPP has powers to discontinue criminal proceedings,” the lawyer said.

Omari wants his client's case withdrawn, saying that just like deputy President Rigathi Gachagua’s case where lawyers had written to the DPP for review and they hope he will look into their case.

In the case, Jumwa and her aide Geoffrey Okuto are accused of killing Ngumbao Njila during Ganda Ward by-elections in Malindi in 2019.

Jumwa has been out of jail on Ksh3 million bond while her co-accused Otieno was released on Ksh1 million bond.

Notably, Jumwa’s corruption case in which she was accused of conspiring to embezzle Ksh19 million from the NG-CDF kitty had also been withdrawn.
