Bouncer, bar manager sued for unlawfully detaining 2 men over unpaid bi*l

Fredrick Kioko and Kevin Oira found themselves in a tight fix on June 24, 2023, after the manager of Embassy Bistro club in Roasters ordered a bouncer to lock them in a storeroom for allegedly refusing to pay their bill.

On the morning of the said date, Kioko and Oira went to the club, where they met their friend, in the company of a woman and two other men.

The said friend had already ordered drinks, but he would shortly leave to escort the woman, who was at the time, very drunk.

Kioko and Oira were left to bond with the other two men, but shortly after the latter left as well.

The two, Kioko and Oira, continued to enjoy the drinks.

In merry and bonding, the two men drank as they waited for their friend, who was to come back after escorting the woman.

However, to their shock, the friend had not returned after a while and eventually never did.

The bill

Kioko and Oira were presented with the bill which amounted to Ksh10,000.

It was at this point that they discovered that their friend had gone with the woman, leaving them with an unpaid bill.

The two refused to pay the bill, following which the club's bouncer locked them up in a store room.

Having been lucky enough to still have their phones in their detention, the two friends called their friend who had left, to come to their rescue.

The friend was quick to respond and report the matter to the police, a matter which would also be taken up by the Kasarani Director of Criminal Investigations(DCI) office.

In response, three officers were sent to rescue the two detainees but did not have it smooth.

Upon arrival, the bar manager Henry Philip Omondi and security guard James Angulu among other workers at the club, refused to let loose of Kioko and Oira, demanding that the two must pay the bill.

Omondi and Angulu made it extremely tough for the police to rescue the duo.

At an extreme point to show their might, Omondi, Angulu and others even banged the car and grabbed the keys, to prevent the police from taking the duo.

The police managed to arrest Omondi on that same day, but Angulu in the company of others took off when they noticed that the police were arresting the bar manager.

However, Angulu was not too lucky, as the police caught up with him after an intensive trace later that day.

Police are still looking for the rest of the suspects, who are still at large.

Omondi and Angulu were arranged in Makadara Law Courts, where they appeared before Senior Principal Gerald Mutiso.

The two were accused of unlawfully detaining Kioko and Oira, Obstructing a police officer which is against section 254 (b) of the criminal procedure code and preventing the officers from rescuing the two complainants.

Additionally, the two accused persons were charged with causing a disturbance which could disturb the peace of others, contrary to section 95 (1) b of the penal code.

The two denied all the charges and were released on a bond of Ksh50,000 with a surety of the same amount and an alternative cash bail of Ksh20,000.

The case is set to be listed for a pre-trial hearing on August 1, 2023.

Having witnessed the happenings, the two police officers among those who went to the site to rescue the two complainants will testify against Omondi and Angulu.

Kioko and Oira will also be witnesses, having witnessed the accused persons 'obstruct the police from undertaking their mandate'.
