Court allows extradition of Kenyan man wanted in Zambia over bank fraud

A Milimani court on Monday, October 30, 2023, ordered the extradition of a Kenyan national wanted in Zambia over financial crimes.

The extradition order against John Wambua Nzuki was issued by Milimani Chief Magistrate Lucas Onyina following an application filed by the Directorate of Public Prosecutions (DPP).

In a statement on Tuesday, the DPP welcomed the ruling, saying Nzuki is wanted in Zambia to face charges of fraudulently transferring approximately $2,700,000 (Ksh406,755,000) from a suspense account of the Intermarket Bank to various customers bank accounts between October 1, 2010, and May 30, 2011.

"Hon. Lucas Onyina found that the DPP's application met the threshold for the issuance of the extradition order," the DP said.

"The DPP had issued an authority to proceed in accordance with section 7(1) of the Extradition Act, Cap 77 of the Laws of Kenya upon being satisfied that the request for extradition met the legal standards."

The recipients of the money are being treated as accomplices in the case.

The suspects are accused of having withdrawn all the money transferred to their various accounts with the intention of sharing it with Nzuki.

"It is alleged that the suspects withdrew all the money transferred to their various accounts while knowing that they had never deposited such money into their bank accounts and would share the money with the fugitive," the DPP said.

The DPP's application followed a request by the Republic of Zambia for extradition of the fugitive.
