CMC di Ravenna, the Italian company linked to the multi-billion Kimwarer & Arror dams scandal, did not bid for the two projects, a witness told the Anti-corruption court on Monday, September 19, 2022.

Charity Mui, the first prosecution witness to take the stand, told Milimani Chief Magistrate Lawrence Mugambi that the accused persons conspired to float tenders for the projects and awarded CMC di Ravenna- Itinera Joint Ventures even though the company did not bid for the projects.

The witness served as a secretary to Kerio Valley Development Authority (KVDA) Adhoc Technical & Evaluation Tendering Committee that evaluated tender documents in respect to the two projects.

"The prosecution led by Special Prosecutor and Senior Counsel Taib Ali Taib has lined up 32 witnesses to prove the case," the Office of the Directorate of Public Prosecutions said on Monday.

In the case, Ex-Treasury Cabinet Secretary Henry Kiplagat Rotich, former KVDA Managing Director David Kimosop and seven others are charged with conspiracy to defraud the Government of Kenya of $501,829,769.43 (Ksh56,360,501,604.99) for the development of Arror and Kimwarer multi-purpose dam projects.

It is alleged that the accused persons committed the offences between December 19, 2014, and July 22, 2019.
