A Kibera Law Court has on Thursday morning issued a warrant of arrest against two Ndichu brothers- Paul and Edward after they skipped court proceedings in their assault case.

Chief Magistrate Ann Mwangi issued the order against the twins after the Director of Public Prosecutions sought to have a warrant of arrest issued for failing to appear in court as earlier directed.

"Since the two accused persons are not in court despite a court order, I therefore issue a warrant of arrest against them. They should be produced in court immediately," Mwangi ordered.

The two were required to appear in court for the mention of their case and have Edward who has since not pleaded to the charges answer to the same after the High Court declined to suspend their prosecution.

Paul had been charged with malicious damage to property and assaulting women at Ole Sereni Hotel in Nairobi and was released on a Ksh100,000 bond with cash bail of the same amount.

According to the charge sheet filed in court, the two brothers face four counts of assault and malicious damage to property from an incident that happened at Emara Olesereni Hotel on the night of October 16 and 17,2021 where they were accused of assaulting two women; Cheryl Murgor and Stephanie Murgor.

Notably, the warrant of arrest against the brothers comes about three weeks after the same was momentarily issued against the Murgor sisters.

On Friday, March 11, 2022, the court momentarily issued a warrant of arrest against Cheryl and Stephanie for skipping a court session where they were to be charged with affray and assault.

Their lawyer Philip Murgor thereafter presented himself in court and requested that the warrant be lifted; a request that was later granted.

According to a charge sheet and court proceedings report, the sisters; alongside three others (Munyra Mohammed, Samuel Dennis Ramdas, and Patrick Kipngetich Koech) were to appear before the court at 12:00 pm on the same day to take plea but they never showed up prompting magistrate William Tulel to issue a warrant of arrest.

The defence counsel Philip Murgor moved to the trial court in the afternoon (2:30 pm) seeking to lift the warrant on grounds that his clients were not aware of the case before court.

After going through his submission, the magistrate lifted the warrant of arrest but issued fresh summons to the accused persons to appear in court on March 22, 2022, to plead to affray and assault charges.

According to the charge sheet tabled in court, the five are alleged to have committed the offence on the night of October 16, 2021, and October 17, 2021, in Langata sub-county within Nairobi County where they allegedly fought each other while at the reception of Emara Ole Sereni hotel, which the prosecutor says is a public place.
