Terror convict wants to remain in jail for fear of being abducted and killed if acquitted

Marsabit Sheik Guyo Gorsa Buru who was arrested and charged with being a member of Al-shabaab and other terrorism charges in 2018 wants the court to suspend his judgement for fear of being abducted and killed after he is acquitted. 

Through lawyer John Khaminwa, the Sheik whose judgement is pending before Nairobi magistrate court alerted the court moments before the reading of the ruling and asked to be given time to file a case at the High Court against the state. 

"The accused is certain he will be acquitted of the offence but he fears that if he is acquitted, he will be abducted and killed by the state," Khaminwa said.

Khaminwa told the court that the recent incidences of abduction of accused persons charged with terrorism after being acquitted by court have caused fear to his client. 

"He told me that he better stay in jail than be killed after he is acquitted " Khaminwa added.

He told Magistrate Kennedy Cheruiyot that he intends to move to the High Court to obtain orders that assures safety of his client.

The Sheik is alleged that on January 13, 2018 at Madarassa Toba within Marsabit town, was found being a member of outlawed group; Al-shabaab.

Magistrate Kennedy Cheruiyot deferred the judgement to December 3, 2021.
