The late Keroche Breweries heiress, Tecra Muigai, had invited guests for a drinking party in the afternoon in her Jaha house hotel in Lamu on the day she died.

This was revealed in an affidavit by the Director of Public Prosecutions who is seeking to have the murder inquest moved to Lamu Law Courts.

One of the witnesses received a phone call informing her that the deceased had fallen and sustained an injury on the ear, the DPP said.

Further, the DPP told the court that the most crucial witnesses live in Lamu and they will be greatly inconvenienced should the inquest be conducted in Nairobi, which is 466km away.

DPP Noordin Haji insists that the inquest must be held at the crime scene, arguing that the evidence collected in Nairobi cannot help unravel the mysterious death of Muigai.

Haji also defended his move to drop the murder charge against Lamu boat operator Omar Lali, who is Muigai's former boyfriend.

According to Haji, there was no sufficient evidence to sustain a murder charge against Lali and an inquest was the best option to establish who or what caused the death of Tecra.

“We established that there was insufficient evidence against the suspect Lari Omari for murder as recommended by investigative agency,” Haji said.

He added that initially, a decision to charge the suspect with murder was made and upon review of the file, he established that there was insufficient evidence to support the case, hence the matter was withdrawn under Section 82 of the Criminal Procedure Code.
