Man sentenced to 20 years in prison for defiling 13-year-old stepdaughter

A man who defiled his 13-year-old stepdaughter has been sentenced to 20 years in prison.

Mark Ikwara was found guilty of the offence after his stepdaughter testified before Shanzu Senior resident magistrate, David Odhiambo.

The minor told the court that her stepfather repeatedly defiled her on several occasions whenever her mother left home for work.

"It was her testimony that the accused would come to where she was sleeping after her mother had left at 6 am and start touching her all over her body before defiling her and later threaten to kill her if she reports to her mother," Odhiambo said.

The magistrate noted that the prosecution had proved its case beyond reasonable doubt that the accused had committed the offence since the complainant's testimony was consistent and confident.

"I have considered the defence by the accused and find that his defence consisted of mere denials and we're therefore a sham, his defence dwelt on the grudges he had with the complainant's mother," Odhiambo added.

Odhiambo additionally informed the court that a senior medical doctor had confirmed that the minor had been defiled repeatedly

The accused had been charged, with the offence of defilement contrary to section 8 (1) as read with section 8 (2) of the sexual offences Act 2006.

The particulars were that on, March 5, 2021, the accused unlawfully and intentionally defiled the minor at Shanzu area in Kisauni sub-county within Mombasa county.
