Senator Linturi now wants to meet woman he is accused of attempting to rape

Meru Senator Mithika Linturi was at the Milimani Law Courts in Nairobi today for a pre-trial session of a case where he is charged with attempting to rape a woman inside a hotel room.

At the session, the Senator asked the prosecution to give him back the money that he allegedly sent to the said woman in a bid to settle the matter amicably after the incident. The woman, in a statement, had indicated that Linturi offered her Ksh200,000 in cash and a Ksh800,000 cheque but later reported them for extorting him.

But speaking to the media after the session, he asked the Director of Public Prosecutions (DPP) Noordin Haji to supply the documentary evidence to expedite his case saying he wants to see his accuser.

"I want to appeal to the Director of Public Prosecutions to supply the evidence in this matter. I don't want any more adjournment by the state. I want to see the lady I'm accused of touching and attempting to rape," Linturi said

The senator also asked the media to provide enough coverage of the rape case saying the case is totally political adding that he wants to clear his name before the 2022 general elections.

Through his lawyer Muthomi Thiankolu, Linturi insisted he wants back his money from the complainant.

"Your honour, I am making an application to have prosecution release Ksh200,000 which is in their possession for the last 1 year. The said money belongs to my client and was recovered from the complainant by the police," Muthoni said.

The lawyer also asked the court to order the state to supply him with the witness statement of the complainant and the OB claiming they were not in the inventory of statements and documentary material supplied to him.

In response, the state prosecutor Alice Mathangani told Magistrate Susan Shitubi that the investigating officer requires time to confirm whether the said documents are in his possession and supply them to the defence team.

Alice also told the court that the Ksh200,000 that Linturi wants the prosecution to return to him is an exhibit that will be used in court as evidence during the trial of the case thus it cannot be released until its produced in court.

The senator was accused of sneaking into a woman's hotel room and attempting to rape her. 

In the charge sheet, the senator is alleged to have committed the offence on January 30, 2021, at Maiyan Villas hotel in Nanyuki.

He also faces another count of indecently touching the woman without her consent. 

He is out on a cash bail of Ksh200,000.

The magistrate has ordered the matter to be mentioned after two weeks.
