Repeat burglary offender gets 5-year-jail term for trying to break into shop in Makueni

A Makueni court has sentenced a repeat offender to five years in prison without the option of a fine for attempted burglary.

Appearing on Thursday before Senior Resident Magistrate George Sagero the accused Benjamin Mutuku pleaded guilty to trying to break and steal in a shop belonging to Joseph Mulwa in Kalawa market on June 29.

The prosecution told the court that the accused was a jailbird who had been previously charged for two accounts of burglary.

He had initially served a three-year sentence in 2019 for similar charges and another six-month imprisonment in 2012 for breaking and stealing in a hotel at the same market.

The accused pleaded for leniency saying he was remorseful and that he would reform.

In the same court, a man was fined ksh10,000, or in default serve three months in prison for being in possession of 75 litres of illicit brew popularly known as Kaluvu

Felix Kioko admitted to the charges contrary to the Alcoholic Drinks Control Act of 2010.

Kioko was arrested on June 30 at Iuani location, Makueni Sub County by police officers following a tip-off by members of the public.

The magistrate convicted him noting that there has been an increase of illicit brewing in the area.

The accused has 14 days to appeal.
