Registrar refuses to expel Malala from Mudavadi’s party

Registrar of Political Parties has refused to endorse Amani National Congress decision to expel Kakamega Senator Cleophas Malala from the party.

In her decision, the Registrar of Political Parties, Ann N. Nderitu, said ANC party did not follow due process in the removal of the rebel senator.

Ms Nderitu cited two reasons for refusing to execute the expulsion decision made by the Musalia Mudavadi-led party.

First, she said the disciplinary proceedings were not conducted within the stipulated timelines under Article 49 of the ANC Party Constitution.

Second, the Registrar said that ANC's National Governing Council did not approve the Disciplinary Committee as reconstituted by the National Executive Council in line with Article 46 of the party constitution.
