Police officer who assaulted civilian during curfew time in 2020 charged

A police officer has been charged with assaulting a civilian at a police station; an incident that happened during curfew time in 2020.

Evans Kemboi who appeared before Milimani Law Courts is alleged to have assaulted Nickson Kiruta Gitau and at the same time damaging two side mirrors of his car. 

"You are charged that at the night of September 25, 2020, at Jogoo road police station within Kamukunji sub-county, you assaulted Nickson Gitau thereby occasioning him actual bodily harm," count one of the charge sheet read. 

In the second count, Kemboi is alleged to have maliciously damaged two side mirrors of motor vehicle registration number KBV 773 worth Ksh30,000 belonging to the complainant. 

The officer pleaded not guilty and in mitigation, for bail, his defence counsel told the court that the accused person is a police officer who is aware of the consequences of failing to turn up in court.

He pleaded with the court to release the accused on bail claiming that his client has been trying to settle the matter with the complainant since September 2020, and the court released him on Ksh15,000 cash bail or bond of Ksh20,000.

The matter will be mentioned on March 3, 2022.
