Police officer charged with allegedly raping woman in cell

A police constable attached to Ukwala Police Station in Siaya was arraigned at Ukwala Law Courts after allegedly raping a woman inside a holding cell at Sega Police Post on April 12, 2021.

On Tuesday, June 14, 2022, Police Constable Cosmas Chirchir was placed in lawful custody after the Independent Police Oversight Authority (IPOA) recommended his arraignment before the law court after finding sufficient evidence he raped the remand prisoner.

IPOA concurred with the Office of Director of Public Prosecutions (ODPP) that there was
sufficient evidence to sustain a trial in court and directed that the officer be charged with rape and abuse of office.

Police to be accused of sexual offence.

"On the strength of our investigation, it was recommended to the ODPP that Police Constable Cosmas Chirchir be charged with the sexual offense," IPOA chairperson Anne Makori said in a statement.

On the fateful day, the woman was detained at Sega Police Post because she did not have a mask.

Separately, in another case, four police constables are expected to be charged at the Bondo Law Courts after they assaulted and caused bodily harm to an innocent citizen.

In December 2016, the four officers on regular duty at Usenge Police Stop inflicted injuries to Samuel Odongo Okwero.

"On directions of the ODPP, after independently reviewing the file, constables Sammy Kirui of Kamagambo police station and Nicholas Ndalo of Ukwala Police station are scheduled to be charged with "assault, causing actual bodily harm," "Makori stated.

ODPP has further directed an identification parade to identify two other officers who may have been involved in the assault.
