My brother collapsed, died hours after being threatened by Kenyan businessman – Spanish man in Ksh176M fraud case tells court

A Spanish citizen wants three Kenyan family members to be detained until a Ksh176 million fraud case is heard citing fear for his life.

Eduardo Hernandez De La Rosa Ciriza in a sworn affidavit before court claims his brother Gonzalo Ciriza collapsed and died hours after being threatened by James Ndwiga Muchungu who is one of the accused persons.

The three family members James Ndwiga Muchungu, Ian Nyagah Ndwiga and Lisa Mumbi Ndwiga were arraigned in court on August 13, 2021, and charged with stealing from Meridian Acceptances Limited Ksh 176 million.

"When the death was reported at Central Police Station, no investigations were carried out," read the affidavit.

He claims if the accused persons are released, they will complete their mission of eliminating the entire family. 

" All the accused persons are relatives and the first accused kicked out all the employees, changed locks and have denied me access to the company since January 2021 yet my family and I were the sole investors having pumped into the company more than Ksh380 million, " read the affidavit. 

The three are also facing charges of obtaining registration of the directorship of the company by forgery and stealing ksh53 million while being the directors of Meridian Acceptances Limited.
