Former Nairobi Governor, Mike Sonko has yet again moved to the high court seeking orders to quash the revocation of the Independent Electoral and boundaries Commission( IEBC) nomination to vie for the Mombasa gubernatorial race.

Sonko through his lawyer Winfred Nyamu filed the petition before Mombasa high court judge Olga Sewe.

In the petition certified as urgent Sonko, is further seeking orders to compel the commission chairperson, Wafula Chebukati and Mombasa county returning officer Swalha Ibrahim Yusuf to gazette his name as one of the governor contestants for Mombasa county.

Sonko has sued Yusuf as the first respondent, IEBC dispute resolution committee listed as the second respondent, IEBC as the third respondent and Wiper democratic party as the fourth respondent.

Sonko argues that the revocation was done notwithstanding Chebukatis and Ibrahim having knowledge of the existence of both the review and reference having been served upon the duo.

"The respondents without colour of right, and in clear breach of the final orders of this court and the provisions of the constitution with the petitioner having moved and filed a review of the supreme court judgment before the East African court of justice the revocation was done with malice and bad faith," Nyamu said.

Sonko further wants the 1st and 3rd respondents be committed to civil jail with a term not exceeding 6 months or for a period the court shall deem fit for deliberate disobedience of the court's judgment not to gazette him.

Sewer directed Sonko to file written submissions tomorrow.

Justice Sewer further issued orders to IEBC to file replying affidavit on Thursday.

The court will issue it's ruling on July 26 this year.
