Man, woman sued for playing loud music in their rental house

A man and a woman were arraigned before Kibera Law Courts Magistrate and charged with the offence of causing public disturbance.

The two allegedly insulted their neighbour who reported them for playing loud music in their area of residence.

Pius Musembi Mulwa and Mary Bosibori Omwenga were arraigned at Kibera law courts where they pleaded not guilty to the offence of creating disturbance against their neighbour.

As per court records, “they created the disturbance in a manner likely to cause a breach of peace by insulting Eunice Aming’a that she will give birth to a lame child.”

The court further heard that the accused persons committed the offence on October 27 at about 1 pm around Lenana in Nairobi’s Riruta area.

The complainant was said to be within their residential area when Musembi approached and asked her why she reported him to the landlord for playing loud music.

The two according to reports have not been on good terms since Musembi is reported to have constantly insulted the complainant by telling her that she cannot bear well-behaved children.

The complainant is said to have grabbed a basin of water and splashed it on the accused in a fete of rage.

The court heard that Bosibori, the second accused then joined the confrontation, threatening to snatch the complainant’s, husband and bear him good and healthy children.

The complainant reported the matter to the police leading to the arrest of the two.

They however denied the accusation and were released on a cash bail of Ksh 30,000 or a bond of Ksh 50,000. The matter shall be mentioned on November 15.
