A man was yesterday sentenced to 12 months in jail or pay a fine of Ksh200,000 at a Milimani law court after being found guilty of assault.
Quackelbeen Johad was convicted after pleading guilty to the assault charges.
The prosecution told the court that on July 27, 2023, at 2:00 PM, the accused attacked Ronald Asumbo by hitting him with his fist on the neck and ear causing him body injuries.
The offence took place along Market Street in Nairobi Central Business District (CBD) within Nairobi County.
The court further heard that the conflict arose between the accused and Asumbo when he alleged that he(Asumbo) had raped his close relative.
The court convicted Johad of assault charges.
In mitigation, he requested the court to be lenient claiming he will never repeat that offence.
"Your honour, I am very sorry for that offence and I am asked the court to be lenient and I will never repeat the same mistakes," he pleaded.
He further cited that he is a grandfather of four and he had been sick for years.
The prosecution told the court to consider the accused being a first-time offender.
In delivering the sentence the chief magistrate Susan Shitubi considered the mitigations and fined the accused Ksh200,000 or alternatively serve one year in jail.
