Man jailed for 3 months for failing to return Ksh16,463 sent to him mistakenly via MPESA

A man has been jailed for 3 months for failing to return Ksh16,000 sent to him erroneously on his MPesa number.

Cyrus Nzoka Maithya, who was charged with two counts of stealing, is said to have stolen Ksh16,463 from an MPesa number registered in the name of Harriet Karimi.

He pleaded guilty before Nairobi Senior Principal magistrate Martha Nazushi and was given a chance to return the money to the owner but he said he had already used the money.

"Cyrus Nzioka Maithya on November 3, 2020, in Nairobi otherwise in the course of stealing dishonesty received Sh16463 in your Mpesa account knowing or having reasons to believe it was stolen" read the second count of the charge sheet.

In mitigation before sentencing, he told the court that he is a parent of two children who depend on him and asked the court to forgive him.

The magistrate slapped him with a 3 months jail term or to pay a Ksh20,000 fine.
