Man in court for raping drunk varsity student after graduation party

A 34-year-old man has been charged with raping a 25-year-old university student after graduation party of her friend.

Ibrahim Malukani Hamisi who appeared before Nairobi Chief Magistrate Francis Andayi is alleged to have committed the offence on July 25, 2021 at Ridgeview hotel in Nairobi.

According to the police report tabled in court, the complainant who is a student at Nazarene University in Nairobi was at Loft Lodge along Garden estate off Thika road where they were celebrating a friend's graduation.

"Around midnight, her friends left her behind and she became intoxicated with drinks," police report read. 

It was when she was trying to find her way home and trying to get a taxi when a man at a restaurant offered her lift to Outering Road where he claimed he lived in too.

The complainant remembered she boarded a blue Toyota car and that after a while she noticed the man had entered Nairobi CBD within Koja area instead of taking her to Outering Road.

According to the report, the complainant tried to alight from the car but the accused hit her using a fist as two other men who were in the vehicle alighted.

After the punch, she became unconscious until when she felt the accused undressing her.

She screamed but he punched her face and she sustained injuries on her eye and mouth. He also strungled her to stop her from screaming.

"When the complainant regained her senses after the blows, she realized she was in a hotel room. She grabbed her cloths and tried to run away but the accused blocked her. She managed to escape and ran downstairs," read the report.

A security lady at the hotel helped her to get a taxi home. She also saw the vehicle of the suspect parked outside the hotel.

The matter was reported at Central police station and investigations commenced and the said vehicle was found to be registered under the accused person.

CCTV footage was obtained from Loft Lodge restaurant and Ridge View hotel which assisted police in tracing the accused.

The accused was traced to be a staff at Classic Coach along Duruma road where he was arrested. 

He pleaded not guilty to three counts of rape, commiting an indecent act with an adult and assault causing grevious bodily harm.

He was released on a cashbail of Ksh300, 000 or bond of Ksh500,000.
