Man charged for failing to pay hotel bill after celebrating his 40th birthday with friends

A 40-year old man has been charged for holding his birthday party with friends at a hotel and failing to pay a Ksh17,250 bill.

Adrian Nderitu Muchira is alleged that on August 22, 2021, at a joint within Nairobi county ordered goods and promised to pay via mobile phone but he never did.

According to police report tabled in court, the accused had visited the bar on August 21, 2021, where he enjoyed himself and requested to be offered services for a birthday party the following day as he would be hosting his friends for the occasion. 

On the fateful day, the accused walked into the hotel at about 8 am and ordered some drinks as he was waiting for his guests who arrived later.

As per his request, his guests were treated to food and drinks whose bill he claimed he would pay through PDQ (Processing Date Quickly) and since the restaurant did not have the machine the management organised for one from town.

After sometimes, he said he would pay through telecom money but he finally failed to pay.

"You are charged that on August 22, 2021, at Cellars Grill Bar and Restaurant within Nairobi county with intent to defraud, you obtained goods from Bonface Shivonje Araka amounting to Ksh17250 that you would pay through Telcom Money a fact you knew to be false," the charge sheet read.

He pleaded guilty before Nairobi Chief Magistrate Francis Andayi but told the court that he sent someone to clear the bill before he was arraigned in court.

Later on, the magistrate released him on Ksh10,000 after the complainant failed to turn up in court.
