Man, 36-year-old niece who’d developed habit of having sex with each other arrested

A 50-year-old man and his 36-year-old niece, both from Bukulunya Sub-Location in Sabatia, Vihiga County, were on Tuesday morning (August 4) frogmarched down the streets after they were caught engaging in sexual intercourse.

Erick Mudiri confessed that he and his niece, Maureen Shitogo, had been in the incestuous relationship for four years, ending in 2019.

Suspicious relatives and neighbours stormed Mudiri’s house shortly after they saw Maureen entering her uncle’s residence at night.

“We caught them stark naked in bed engaging in sexual intercourse,” a relative of Mudiri, who sought anonymity, told K24 Digital.

The 50-year-old man was formerly married and has children with his ex-spouse, who lives in Mombasa.

“Around five years ago, he returned to Vihiga and shortly thereafter, started a relationship with his niece, who was someone’s wife at the time. Three years ago, Maureen ditched her husband so that she could continue with her incestuous relationship with Mudiri,” revealed our informant.

Mudiri said last year, elders and his family members successfully implored upon them to bring to an end the frowned upon affair after Maureen conceived twice during the relationship. The two currently have three children together.

The 50-year-old man, who denied that he was engaging in sexual intercourse with his niece when they were busted Monday, however, couldn’t explain why his niece was caught naked in bed with him.

Mudiri and Maureen were taken to Lunyerere Police Station, where they are being held in custody.

Mudiri is the younger brother of Maureen’s biological father, who is deceased.

Mudiri and Maureen are staring at at least 10 years in jail each should they be arraigned and found guilty of committing incest, contrary to Sections 20 and 21 of Kenya’s Sexual Offences Act 2006.

Section 20 of the Act, which focuses on male incest suspects, states that: “Any male person who commits an indecent act or an act which causes penetration with a female person who is to his knowledge his daughter, granddaughter, sister, mother, niece, aunt or grandmother is guilty of an offence termed incest and is liable to imprisonment for a term of not less than ten years immaterial that the act which causes penetration or the indecent act was obtained with the consent of the female person.”

Section 21 of the Act, which focuses on female incest suspects, says: “The provisions of section 20 shall apply mutatis mutandis with respect to any female person who commits an indecent act or act which causes penetration with a male person who is to her knowledge her son, father, grandson grand father, brother, nephew or uncle.”
