Kisumu man arraigned for allegedly defiling a minor

A middle-aged man who allegedly defiled a 13-year-old girl was on Monday arraigned before a Kisumu court.

Nelson Opiyo who appeared before Senior Principal Magistrate Joan Wambilyianga was charged with the offence contrary to section 8(1) (3) of the sexual offences act No 3 of 2006.

The court heard that Opiyo intentionally and unlawfully gained the canal knowledge of the minor on January 6, 2022, at Delta area of Nyalenda B slums within Kisumu.

According to the charge sheet, Opiyo was also charged with committing an indecent act with a child contrary to section 11(1) of the sexual offences act No 3 of 2006.

He, however, pleaded not guilty to all the charges against him and was released on a bond of Ksh150,000.

"I also direct that the accused person be supplied with copies of charge sheet and the witnesses statements," she said.

The prosecution has lined up 8 witnesses to testify before the court.

The case will be mentioned on January 24 and heard on February 22, 2022.
