Miguna Miguna says he won’t honour the court order directing him to visit the Kenyan Embassy to apply for citizenship to be allowed back into the country. He maintains that he is a Kenyan by birth who must enter Kenya by ID only.
On his official tweeter account, Miguna has said he never lost his Kenya Citizenship hence he won’t visit the Embassy to apply.
“I'm not visiting the Kenyan Embassy to apply for citizenship which I never lost. The Court has once more AFFIRMED that I am a Kenyan by birth who must enter Kenya as a Kenyan upon presentation of my National ID card. The Embassy has been ORDERED to issue a travel document,” wrote Miguna on tweeter.
Miguna statement comes after the court ruled that he should obtain emergency travel documents from the Kenya High Commission Ontawa Canada, or Kenya High Commission Berlin Germany or from wherever he is within 72 hours so that he can fly to Kenya.
“Once in possession of the emergency travel documents and upon presentation of the same to the 2nd respondent, Air France should allow Miguna to board the available flight to Kenya with immediate effect,” ruled the judge.
The Judge noted that an Identity card is not a travel document that he can use to travel to other countries. He said upon landing in Kenya is when he will be allowed to use the Identity card.
“It is only upon landing in Kenya, that he will use his identity card for purposes of identification since he does not have a Kenyan passport. The orders issued by Justice Korir on January 6 were for purposes of use of his ID, for identification only and not travels in and out of Kenya,” he ruled.
