Presidential petition: IEBC opens servers for scrutiny

Independent Electoral and Boundaries Commission (IEBC) now says the commission has complied with the Supreme Court order to allow parties in the ongoing presidential election petition to access the servers used in the August 9 general election.

"Following the Supreme Court order, @IEBCKenya has granted access to the parties to access the servers and the scrutiny exercise is ongoing," the commission said on Twitter on Wednesday, August 31.

The new development comes hours after Raila Odinga and Martha Karua lead lawyer James Orengo told the court that the commission was yet to comply with the order.

Orengo argued that they had been given access to one server and there were eight of them used in the general election.

"We are having difficulties with the orders relating to the inspection of the servers. We have been given restricted access only to the result transmission system.

"We can only access one server and it is established that the IEBC has got eight servers.

"There is no compliance in terms of the orders the court gave," Orengo said.

Court orders IEBC to grant access to servers

During the pre-trial conference on Tuesday, August 30, the Supreme Court ordered the IEBC to grant supervised access to the servers to all parties in the presidential case.

"That IEBC is compelled to give the applicants supervised access to any server(s) at the National Tallying Centre for storing and transmitting voting information and which are forensically imaged to capture a copy of the Form 34C which is the total votes cast," read court orders.
