Hawkers narrate how Nairobi Central police station officers framed them for failing to Ksh50k bribe

Central Police Station in Nairobi is on the spot after a city hawker and a businessman narrated to the court how officers from the station framed them for being in possession of a dangerous weapon, a military dagger after they failed to part with a Ksh50,000 bribe.

Evanson Maina Kingori and Eliud Biwott who were arraigned before Milimani Chief Magistrate Wendy Kagendo on Thursday, October 27, 2022, on charges of preparation to commit a felony narrated how they were arrested and detained for failing to part with a Ksh50,000 bribe as requested by the arresting officers.

The officers are said to have been patrolling the city center when they arrested the duo.

Kingori, while explaining the circumstances surrounding his case, told the court that at the time of the arrest on October 25 at around 7 p.m he was carrying out his ‘mitumba’ business along Mfangano Lane within Nairobi Central Business Center(CBD).

He went ahead to inform the court that the arresting officer whose name he did not mention called him by his street name demanding money from him.

“I was surprised when the police officer called me by my street name ‘Prof’. He told me if I did not give him the money he would frame me for being in possession of bhang,” Kingori informed the court.

According to him, after refusing to part bend to the officer's demand for money, he was escorted to Central Police Station, Nairobi county.

“Your honour, I was previously a pickpocket around Nairobi CBD but I currently sell ‘mitumba’ for a living. I was not in possession of either the dagger or bhang as alleged,” he informed the court as he pleaded to be freed

Biwott on his part told the court that at the time of his arrest at 1900 hours, along Railways in Nairobi county, he was going to visit his sick wife at a city hospital.

“Your honour, in my hand I was holding a bottle of water worth Ksh 30. I was stopped by a police officer who asked me to identify myself. I told him my name and later gave him my National Identification Card,” he narrated.

Biwott told the court that the police officer later asked him for Ksh50,000 which he did not have. He was later taken to Central Police Station and implicated with being in possession of a dagger.

The two were separately charged that on October 25, 2022, they were found in possession of a dangerous weapon namely a Military Dagger in circumstances that indicate they were intending to commit a felony namely stealing.

According to the charge sheet, the two accused persons were arrested on October 25 but arraigned in court on October 27, 2022.

In the case against Bitwott who was arrested at Railways those listed as witnesses are officers Corporal Geoffrey Nyaore and Police Constables Jackson Kioko and Godfrey Mbae while in the case against Kingori are Sergeant Timothy Waweru and Police constables Waweru and Maina. The officers are all from Central Police Station, Nairobi.

The magistrate ordered the two accused persons to be released on a bond of Sh50,000 with an alternative cash bail of Sh20,000 each.
