Four Mombasa residents have moved to the Labour and relations court seeking orders to set aside Mombasa governor Abdulswamad Nassir's nomination of County Executive Members(CEC) and 7 advisors.
The four namely Abduli Majid Ali, Mesh Mwaniki, Maria Magdalene Ferdandes and Mohammed Mohsin in the application filed under a certificate of urgency are seeking for interim orders restraining the county head from debuting, vetting and approving the nomination of the nominees pending the hearing and determination of the application.
The four have also sought interim orders restraining the interested parties (nominees) from taking office. They argued that the entire list of nominations and appointments falls short of the local employment scheme which mandates such positions to cater for the local residents' needs to the tune of 70%.
They have further averred that the process was flawed, lacked public participation, lacked transparency and the executive order was issued through the governor's social media platforms.
"Further, such appointments ought to be subjected to public participation as envisioned in the constitution. However, the appointments were shrouded with a lot of secrecy,"part of the application reads in parts.
The petitioners have also stated that the appointment of the 10 nominees is in contravention of the two-thirds gender rule on public appointments since there are only two women nominees in comparison to the eight men.
"The first respondent nominee for the county Attorney is an incumbent in the said office and has been in the acting capacity for the last ten years in the previous regimes whose term expired upon assumption of office by the current governor," they added.
On Sunday, Nassir named his 10 county executive committee members (CEC) and seven advisors after he took office five months ago.
