Before her sentence is delivered by the judges in an Australian court today, former journalist Esther Arunga will be given an opportunity to mitigate the charges.

Arunga who is facing charges of lying to the court over her husband’s involvement in their son’s death, will have a chance to explain the circumstances that will affect the sentence.

“As standard practice during sentencing, the accused or their advocate is given  a chance to present arguments before the judge.

The judge has the discretion to determine the sentence to give,” says advocate Tom Obel of Obel and Company Advocates.  Esther faces a term of maximum of 25 years in jail.

Moses Kimuli,  an advocate,  says the fact that a parent has a young child to take care of is taken into consideration but it depends with the circumstances.
