Drama in court as woman accuses Supreme Court judge of siring, neglecting her 6-year-old child

A youthful woman caused drama at the Milimani Law Courts on Tuesday, June 30, accusing a Supreme Court judge of siring and neglecting their 6-year-old daughter. She broke in tears and screamed demanding her case be heard and determined expeditiously.

Mary Kwamboka Onyancha said, in her suit documents, that she met the judge in 2013, and their affair, which spilled over to 2014, yielded a daughter, who was born on April 21, 2014. Kwamboka says she met the judge in church.

“Upon the birth of the minor, the plaintiff (Kwamboka) requested the defendant for child support, but the defendant adamantly refused and denied paternity of the minor,” the woman says in her court papers.

Kwamboka claims the judge, who was dispensing justice in a lower court at the time, “frustrated all the efforts by the plaintiff to reach out to him for child support”.

The plaintiff claims she is yet to receive even a single coin as child support from the judge.

“The defendant has refused, and or failed to provide for food, clothing, shelter and medical cover for the minor,” said Kwamboka in her suit.

The complainant now wants the court to instruct the judge to pay her a monthly support of Ksh161, 600.

She said Ksh20, 000 will cater for food, Ksh5, 000 will be spent on clothes, Ksh45, 000 will foot house rent expenses, Ksh41, 600 will go towards paying the child’s school fees, Ksh20, 000 will cover her medical expenses, Ksh10, 000 will be used in paying a house-help and Ksh20, 000 will be channeled to the child’s entertainment kitty.

“The defendant is a man of means as he is currently a judge of the Supreme Court, and should not have a problem maintaining the minor as per the claim above,” said Kwamboka.

The woman also wants the court to declare her the sole custodian of the child.

The lawsuit dated Tuesday, June 30, 2020 was filed at the Children’s Court in Milimani.

The plaintiff attached the child’s birth certificate, Cathsam School fee structure and Tulima Court house rent receipts.

The woman further carried with her documents showing she had allegedly filed a formal complaint against the judge at the Children’s Department Office in Makadara, Nairobi on March 10, 2020.

“By a copy of this letter, you are required to come to our Makadara District Office on March 23, 2020 at 10am to assist our officers in the said-family assessment. During the family assessment process, we will discuss individual and family strengths and the parenting responsibilities. With the information gathered, we will develop a plan of action that will support the protection and safety of the child,” reads a part of the letter addressed to the judge.

The woman says her attempts to successfully file for child support against the judge have been futile, given “he has been using his powerful posting to frustrate my efforts”.
