Division in IEBC commissioners was caused by NSAC – Kioko Kilukumi

President-elect William Ruto's lawyer Kioko Kilukumi told the Supreme Court on Thursday, September 1, that the division in the Independent Electoral and Boundaries Commission (IEBC) was caused by the National Security Advisory Council (NSAC) members who visited the National Tallying Centre at Bomas of Kenya on Monday, August 15, 2022.

Kilukumi narrated the events that happened on the day of the announcement of the presidential election results that led to the division in the commission.

"If you look at the events preceding the announcement of the results, you can easily draw a conclusion of who caused the division in IEBC.

"The meeting between NSAC team and IEBC commissioners starts past 2 pm, the election results are to be declared at 3 pm, and at 4 pm, the four commissioners are at Serena Hotel.

"Our television screens are split with one side saying four commissioners have disowned the election results and the other side showing the attack at Bomas," Kilukumi told the judges.

IEBC Chair's affidavit

The lawyer further reiterated an affidavit sworn by the IEBC Chairman Wafula Chebukati before the Supreme Court saying the NSAC team wanted to "subvert" the will of the people.

"In his affidavit, Chebukati said the message from NSAC was simple; declare the first petitioner (Raila Odinga) as the winner or massage the results to allow a run-off.

"The four commissioners say they should accept the NSAC advisory and the three others say they will not agree with it and they will abide by their oath of office," he added.

Ruto's lawyer also said despite the heavy presence of security officers at Bomas, no one was arrested for causing the chaos.

"The will of the people was about to be subverted but it was unsuccessful because the three commissioners stood by their stood oath of office," he stated.
