Dispute between IEBC commissioners is an internal matter – Supreme Court

Four dissenting Independent Electoral and Boundaries Commission (IEBC) commissioners have suffered a blow after Supreme Court declined to admit lawyers they had chosen to represent the commission in the ongoing presidential petition.

Deputy Chief Justice Philomena Mwilu on behalf of the court said the difference between IEBC commissioners was an internal one and the court was only aware of one commission.

Mwilu said it is not the court's mandate to resolve which lawyer will represent IEBC at the Supreme Court.

"This court cannot deal with the issue or dispute of the legal representation of IEBC in this petition.

"We have considered the proceedings. It is not the business of the court but rather an internal issue that must be resolved by the IEBC and the commissioners.

"This court will not be drawn into this dispute," Mwilu said.

The court further struck out the appointment of Issa and Co. Advocates by four of the IEBC Commissioners led by Vice-Chair Juliana Cherera who are opposed to the presidential election results announced by its Chairman Wafula Chebukati.

Mwilu said the four commissioners can utilise the services of Senior Counsel Paul Muite if they deem it necessary in the proceedings.

Chebukati's faction is being represented by former Attorney-General Githu Muigai.
