A three-judge bench has lifted orders blocking Independent Electoral and Boundaries Commission (IEBC) from clearing former Nairobi Governor Mike Mbuvi Sonko and Kiambu senatorial aspirant Karungo wa Thang’wa.

The bench led by Justice David Majanja ruled that the issue of eligibility is the core subject for determination in the consolidated petitions and the parties ought to be given an opportunity to be heard before orders of this nature are issued.

“The orders denied the IEBC the constitutional mandate to discharge its duty which includes deciding whether to accept or decline at the nomination stage. The process is governed by clear constitutional statutory provisions,” the ruling read in part.
