Court gives Speaker Lusaka more time to negotiate with woman seeking upkeep for their unborn baby

The High court has given Senate speaker Kenneth Lusaka until July 28 to negotiate with a woman seeking him to pay ksh25 million for the upkeep of their unborn child, with a view to having the matter settled out of court.

Justice Antony Mrima allowed Lusaka and his mistress more time to negotiate on the issues raised in the petition and record a consent on the same.

"I will accord the parties time to negotiate and mention this matter with a view to record a consent on July 28, 2021," ordered Mrima.

This is after Lusaka's mistress through lawyer Danstan Omari informed the court that they have started negotiations in the matter and sought seven days to conclude the same.

Lusaka's lawyer Peter Wanyama also confirmed to court that it's true that the speaker has engaged the woman with a view to have the case settled out if court.

"Lusaka is engaging the lady in a view to addressing the issues in the case before court. Once the baby is born in about seven months, we can then substantively address the issue on the upkeep of the baby," the lawyer said.

He urged the court to grant Lusaka a month to enable him to conclude the ongoing negotiations over the prenatal care expenses.

He added that it would not be possible to conclude the negotiations within a week as the lady is seeking to be bought for a house and the seven days is not enough to do so.

Last month he petitioned the court seeking orders compelling Lusaka to make a monthly maintenance of Sh200,000 in order for her to meet the direct or indirect needs of their unborn child.

“Pending the hearing and determination of this petition, the respondent is hereby ordered to support the un-born child by making a lump-sum payment of ksh25,000,000 or any other reasonable amount in the circumstance which should meet the direct and/or indirect needs of their unborn child and after its birth,” the petition read.

Through Omari, the lady wants the court to compel Lusaka to accept and take responsibility for their child.

According to Omari, his client and Lusaka have been in a jolly intimate affair since 2018 up until about two months ago (May 2021) when they disagreed after she disclosed to him that as a consequence of their relationship, she had conceived.

The woman claims that they fell out with Lusaka when he insisted she terminates the pregnancy but says she is ready for DNA to confirm paternity.

"Despite Lusaka being a man of means he has refused, neglected and ignored to take care of her Pre-natal Clinics necessary to ensure the wellbeing of the un-born child," reads the court papers.

The woman claims that Lusaka has consistently rejected his association with the pregnancy despite his full knowledge that they have been having unprotected carnal knowledge together for years now instead of subjecting himself to a scientific examination in order to put his doubts to flight.

Omari argues that his client, being unemployed and the pregnancy being a high-risk one, and of a child that would possibly rise to the position of the Speaker of the Senate, the position its father has risen in the governance of the Republic of Kenya, or even higher in the leadership of this Country, her maintenance needs are of national importance and priority by all standards

“Unless this matter is disposed and determined on a priority basis and ex- parte orders granted irreparable damage and prejudice will be occasioned on the un-born child and or its mother yet the cause of the pregnancy in question is a well to do individual that runs the risk of improperly mentoring young men to be irresponsible men and fathers,” Omari claims.

Omari claims that his client has been going through Pregnancy complications that potentially threaten the life of their unborn child if unmitigated and largely because she is unable to financially meet the cost of the hospitals that guarantee expectant women the highest standard of health commensurate to the class and statute of the senate speaker.

She also wants the court to order Lusaka to include her in his Medical Scheme to safeguard the welfare of the un-born.

"Lusaka's defiant and brazen refusal to accept responsibility and assist the Applicant to access esteemed hospitals capable of giving her highest standard of prenatal care threaten the life of their unborn child and is therefore is in sharp contravention with the Constitutional safeguards of life which begins at conception," reads court documents.
