Acting Head of Finance at the Judiciary has received a reprieve as Labour Relations court blocks judiciary from replacing her.

Susan Khakasa Oyatsi, who has been the acting Director of Finance since 2016, got a major win after the court quashed an advertisement put in the dailies by the JSC calling for applications for the position.

Justice Mathews Nduma said she is deemed to have been lawfully appointed to the position since May 2018 when the 18-month period lapsed.

"A declaration is hereby issued that the petitioner Oyatsi is deemed to have been lawfully appointed to the position of Director Finance of the Judiciary upon expiry of eighteen months from the date of appointment in an acting capacity on December 2, 2016," Judge Nduma ordered.

The court has also ordered Judicial Service Commission to pay Oyatsi total underpayments calculated at Ksh3,572,320 per year from May 2, 2018, to date.
