Police officer arrested for defiling minor in Nyeri

A police officer attached to Kiganjo National Police College Main Campus in Kiganjo, Nyeri County will be arraigned at the Nyeri Law Courts for the offense of defiling a two and half-year-old baby belonging to his neighbour a fellow officer at the college.

Constable Silvester Kirwa, who was also a driver at the college, was on Thursday, September 8 arrested following the report of the order by the office of the Director of Public Prosecution (ODPP) Nyeri who recommended his immediate arrest.

A case inquiry file was opened by the ODPP on May 11, 2022 after the case was reported.

"Please be informed that Police Constable and Driver Silverster Kirwa of National Police College Main Campus Kiganjo has been arrested today 8/9/2022 following an inquiry file 3/2022 opened on defilement incident report an offense he committed and was reported on 11/5/2022," the police report read in part.

Kirwa is reported to have committed the act against the minor at the college quaters where they reside.

This comes a month after a General Service Unit (GSU) officer attached to the embassy protection unit was arrested for the offense of incest.

Investigations revealed that Constable Omar Dae had defiled his own daughter, then aged 9 years, in June 2019 at their residence in Nairobi.

The file was then forwarded to the Director of Public Prosecution (DPP) who upon perusal of the file directed that the officer be charged with the offense of incest, contrary to the sexual offenses act.

“The ODPP recommended that the suspect be charged with the offenses of incest and assault causing actual bodily harm. He has been arrested and placed in custody awaiting arraignment,” police said.

According to women and children’s rights crusaders, incest is on the rise in the country and thrives under a culture of silence, stigma, and fear.

Ironically, the homes are no longer safe for girls as their relatives and trusted protectors are among the top offenders according to the national hotline 1195.

The extent of incest and other sexual abuses is difficult to measure because the crime remains largely underreported and lacks memory.

According to Section 20(1) of the Sexual Offences Act, any male person who commits incest is liable to imprisonment for a term of not less than ten years.

However, if the female person is under the age of 18 years, the accused shall be liable to imprisonment for life.
