Reprieve for Ndichu brothers as Murgor sisters withdraw assault case

Two Ndichu brothers, Paul and Edward, can heave a sigh of relief after a Kibera court on Tuesday, December 6, allowed an application to terminate an assault case against them.

The move follows an out-of-court settlement reached between the brothers and the complainants — Cheryl Mugor and Stephanie Murgor — who had accused the twins of assaulting them at Ole Sereni Hotel in Nairobi.

The two Murgor sisters had on November 12 urged Kibera Senior Resident Magistrate Renee Kitagawa to drop charges against the accused persons after they tendered an apology regarding the ugly altercation at Ole Sereni on October 17, 2021.

"This is to inform the public at large that the Ndichu brothers have now offered an unequivocal apology dated November to Murgor sisters(Cheryll Mugor, Stephanie Murgor) and their companions(Samuel Ramdas and Patrick Koech for the unfortunate events that occurred on the night of October 17, 2021 at Mara Ole Sereni Hotel," the court heard.

The magistrate said the criminal cases against the duo stand withdrawn.

The brothers were on March 9, 2022, charged before Kibera law courts with malicious damage to property and assaulting women at Ole Sereni Hotel in Nairobi.

They were each released on a Ksh100,000 bond with cash bail of the same amount.

According to the charge sheet filed in court, the two brothers faced four counts of assault and malicious damage to property.

In the first count, Paul was accused that on the night of October 16 and 17, 2021 at Emara Ole Sereni Hotel at Langata Sub-county assaulted Cheryl Murgor causing her actual bodily harm.

In the second count, Paul and Eddie were jointly accused of damaging side mirrors of a vehicle that belonged to Samuel Dennis Ramdas at the hotel valued at Ksh 87,000.

On the third and fourth counts, Paul was accused of assaulting Chelimo Murgor and Stephanie Murgor.
