A carpenter who stole four claw hammers from Naivas Supermarket has been sentenced to four months in jail with an alternative of a Ksh50,000 fine.

The carpenter, David Guthi Mutuo who pleaded guilty to the offence had pleaded with the court to give him time to pay the supermarket Ksh2400, the value of the hammers but the court dismissed his request.

During his mitigation in court, the 32-year-old lamented that he stole the items because he needed them to make a livelihood for his family.

"Your honour, I did not intend to steal, I needed the hammers to provide for my family," Mutuo said.

He committed the offence at Naivas Supermarket Development House along Moi Avenue in Nairobi on March 1, 2022.

"On March 1, 2022, at Naivas Supermarket Development House Moi Avenue within Nairobi county you stole four pieces of claw hammer metal HB 29mm and two pieces of chisel pointed all valued at Ksh2400 the property of Naivas Supermarket " the convict's charge sheet read.

According to the police cover report read out in court, on the material day the complainant Geoffrey Kirui on behalf of Naivas Supermarket reported that while on his duties as the CCTV footage controller viewed the footage and noticed that the accused person was shoplifting some items and trying to exit without payment.

Following the incident, the CCTV controller said that he was forced to leave his desk and run to the exit door of the supermarket where he stopped the accused from escaping.

Upon searching him, the controller said that he found the items hidden inside Mutuo's jacket prompting him to call police who came and escorted him to Central Police Station.
